Srinagar, Dec 23 (KS): In a decisive move aimed at ensuring fair and transparent admission processes in private schools, the Directorate of School Education in Jammu & Kashmir, under the authority of the Government, has issued a circular directing recognized private institutions to refrain from charging capitation fees and conducting screening tests during admissions.

According to the circular circular, of which a copy lies with news agency Kashmir Scroll, prompted by reported instances of certain private schools allegedly imposing capitation fees at the time of admission, emphasizes the importance of adhering to the Right to Education Act 2009. This legislation explicitly prohibits schools from collecting any capitation fee during admissions and subjecting students to screening procedures.

The Right to Education Act, in Section 13, outlines severe consequences for non-compliance. Schools found in violation of these regulations could face fines up to ten times the capitation fee charged. Additionally, fines ranging from twenty-five thousand to fifty thousand rupees may be imposed for subjecting students to screening procedures.

Highlighting the broader objective of promoting transparent and non-discriminatory admission procedures, the circular discourages schools from conducting interviews and screening tests during the admission process. The focus is on creating inclusive learning environments that provide equal opportunities for students from diverse social and economic backgrounds.

Acknowledging complaints from parents and civil society about certain private schools demanding admission fees, the Education Department takes a firm stance on the matter. The circular serves as a warning to private institutions, stating that any deviation from the stipulated guidelines may result in severe consequences, including the cancellation of the school’s registration.

Furthermore, the circular addresses concerns about schools deviating from the academic calendar, as per the National Education Policy 2020. It emphasizes that the admission season in Jammu & Kashmir should commence in March.

Chief Education Officers are designated as key figures responsible for overseeing the implementation of these guidelines within their respective jurisdictions. Their role includes monitoring private schools to ensure compliance with the directives outlined in the circular. (KS)
